Kolkata , October 21 ,2011 : Since the last few years , I have been doing a job . I usually visit a tea shop daily at 10:00 PM at night after my whole day’s job and there , I visit some of my childhood friends who also come there to meet each other .The place is situated at Beleghata Ward No. 33 near Volkswagen Showroom in kolkata . We go there just only to have tea .. no wine … no alcohol .. no politics … just a kind of mind refreshment and hanging out with friends for one or one and half hours .

Last night on October 20 ,2011 , Some policemen from Beleghata PS came there while petrolling . It’s fine when policemen move across the city to ensure law and order . They ordered the tea vendor to close his shop by 9 PM and ordered us to move out from there . They advised us to have tea in our locality . However , the tea shop where we go daily is not our exact locality but we live within 1 or 2 KM radius areas .

Now , I have some questions to the people related with administration and legislation and I hope they have the answers what I am seeking here .

According to the constitutional right of every citizen of India , we are like free birds who can move anywhere from Kashmir to Kanyakumarika without any hesitation and here I must admit that we only can go there where law and order is intact and our appearance doesn’t make any change in the peaceful situation of the area .So , here is my first question ;

who gave them the right to evict us from the place where law and order is intact ? and which law was applied to do so ?

Does Indian Constitution provide such power to the policemen to trash someone’s fundamental rights ?

According to the law , policemen can ask for your information or identity if they find anything doubtful and they have the constitutional right to do so . But , can they evict you from a place after they become aware about your identity ?

This is my pocket and the money in it is mine and so where to go and where to take tea is my matter .Can they suggest where to take tea ? Can they advise to take tea in our locality ? What’s this ?

Policemen claimed that people drink there where we sit .It is fine to block such activities . But this is not fine to force out people who are not related with drinking alcohol there .

Poor people who sell tea for their livelihood would close their shop by 9 PM but what about them who sell illegal wine and marijuana to that area and contiguous areas for whole night ?

Why don’t they place some policemen there for all the time in the evening to keep watching on the situation  ?

If we are evicted from a place with a cause concerning our security , I must admit that they can’t provide our security in the streets at night and that was why we were told to move home .

They are public servants who have been appointed to serve public but not to trash the fundamental rights of human beings .

My next question goes there ;

What should I have done there when they forced us out of the place and when they broke our basic fundamental rights with the help of constitutional power ?

Was the act 144 issued there at last night at that area ?

If it was issued ..why didn’t they put a notice board to let people be aware about it ?

Were they given any special power ?

Having power is fine to ensure law and order but having power and utilizing it to show off or misusing it is not fine .

However , kolkata is not like Maoist infested JungleMahal .Kolkata is not like terrorist infested Manipur or Asam . Kolkata is a safe place .Here , I must admit that once the chief minister of Delhi ,Shila Dixit told that in kolkata, women are more secured than Delhi .

Why did she say so ? She explained the reason .She told the people of kolkata are more conscious and that’s why the crime against women is less than any other states in India. And here is the point I am going to mention .

Is it possible to keep the law and order intact without the help of general people ? Must know , general people love peace and that’s why the city sleeps well . The number of policemen are limited and it is not possible to reach everywhere – every moment and proper moment for them and this is scientifically proved . So, maximum of the job to keep the law and order intact are also done by general people.

I am also a little bit worried about the newly politically involved youths who reside at that area ,76 No. Pally , Beleghata . They tried to convince the policemen against us telling them that the drinking job is done by the people who come from different places .

However , they couldn’t make any preference for them . I don’t know what made them so jealous . But the mentality , my locality and your locality can’t improve a nation . I strongly consider the mentality as a sick mentality .

I don’t know Who involved them into politics and on what basis ? Selling building materials and in the evening alcohol and then threatening people to show off power … Is this called youth power ? Shouldn’t strict rules be made for such party workers ? I must admit that the situation reminds me about some party workers of left-ruling period .

I appeal to all the people related with administration and legislation to look into the matter .
